These Terms should be read together with our Privacy Policy.

1. Acceptance of these Terms

These Terms and Conditions (“Terms”) govern your access to and use of the website afytd.org, its subdomains, and all related fundraising campaigns, events, donation pages, and communications operated by or on behalf of American Friends of Yeshivas Temimei Darech, a US 501(c)(3) charitable organization, EIN 27-1185788 (“AFYTD,” “we,” “us,” or “our”), whether now existing or launched in the future (collectively, the “Services”).

By accessing or using the Services, making a donation, or registering for an event, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Services.

2. About the organization

AFYTD is a US-based 501(c)(3) charitable organization located at 261 Old York Road, Suite 514, Jenkintown, PA 19046. AFYTD receives charitable gifts in the United States and grants support to charitable and educational causes consistent with its exempt purposes.

3. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, and have the legal capacity to enter into these Terms, in order to make a donation or register for events on your own behalf. By using the Services, you represent that you meet these requirements and that any information you provide is accurate and complete.

4. Donations

4.1 Authorization

When you make a donation, you authorize AFYTD and its payment processors to charge the payment method you provide for the amount and at the frequency you select. You represent that you are authorized to use that payment method.

4.2 Recurring gifts

If you elect to make a recurring (for example, monthly) donation, you authorize recurring charges to your payment method until you cancel. You may cancel a recurring gift at any time by contacting us using the details in Section 14; cancellation takes effect for future charges and does not affect charges already processed.

4.3 Tax deductibility

AFYTD is a registered 501(c)(3) organization (EIN 27-1185788), and donations may be tax-deductible in the United States to the extent permitted by law. No goods or services are provided in exchange for a contribution unless expressly stated at the time of the gift; where goods or services are provided, the deductible amount may be reduced accordingly. We do not provide tax or legal advice — please consult your own advisor regarding the deductibility of any contribution.

4.4 Receipts

A receipt or acknowledgment will be sent to the email address you provide. Please retain it for your records.

4.5 Use of funds

Donations support the charitable and educational purposes of AFYTD, including grants made in furtherance of its exempt mission. Unless a gift is designated for a specific purpose and we have agreed to that designation in writing, we may apply funds where the need is greatest. If a designated purpose is fully funded, discontinued, or otherwise unable to use the funds as designated, we may reallocate them to a similar purpose consistent with our charitable mission.

4.6 Refunds

Donations are generally non-refundable. If you believe a donation was made in error, was unauthorized, or was charged incorrectly, contact us promptly using the details in Section 14, and we will review the request in good faith. Refunds, if approved, will be returned to the original payment method.

4.7 Currency and fees

Donations are processed in the currency indicated at checkout. You are responsible for any fees your bank or card issuer may charge, including currency-conversion or international-transaction fees.

5. Events and campaigns

5.1 Additional terms

Specific events and fundraising campaigns may have additional terms, eligibility requirements, deadlines, or registration fees. Where additional terms apply, they supplement these Terms; if there is a conflict, the specific terms for that event or campaign control to the extent of the conflict.

5.2 Changes and cancellations

We may modify, postpone, or cancel any event or campaign. We will make reasonable efforts to notify affected participants, but we are not liable for costs you incur in connection with such changes, except as required by law.

6. Acceptable use

You agree not to:

  • Use the Services for any unlawful, fraudulent, or harmful purpose.
  • Submit false, misleading, or unauthorized information, including unauthorized payment details.
  • Interfere with or disrupt the Services, servers, or networks, or attempt to gain unauthorized access to any part of them.
  • Use any automated means to access, scrape, or collect data from the Services without our prior written permission.
  • Upload or transmit malicious code, or engage in any activity that infringes the rights of others or violates these Terms.

7. Intellectual property

All content on the Services — including text, graphics, logos, images, and the name “American Friends of Yeshivas Temimei Darech” — is owned by or licensed to us and is protected by applicable intellectual property laws. You may view and use the content for personal, non-commercial purposes only. You may not copy, reproduce, distribute, modify, or create derivative works without our prior written consent, except as permitted by law.

8. Third-party services and links

The Services rely on third-party providers (such as payment processors and event or donation platforms) and may contain links to third-party websites. We do not control and are not responsible for the content, policies, or practices of any third party. Your use of third-party services is governed by their own terms and privacy policies.

9. Disclaimers

The Services are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, error-free, or free of harmful components, or that any information provided is complete or current. Nothing on the Services constitutes tax, legal, or financial advice.

10. Limitation of liability

To the fullest extent permitted by law, neither AFYTD nor its officers, directors, employees, volunteers, or agents will be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or goodwill, arising out of or relating to your use of the Services, even if advised of the possibility of such damages. To the fullest extent permitted by law, our total aggregate liability for any claim relating to the Services will not exceed the amount of the donation or fee you paid to AFYTD in connection with the matter giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless AFYTD and its officers, directors, employees, volunteers, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of your use of the Services, your violation of these Terms, or your violation of any rights of a third party.

12. Governing law and disputes

These Terms are governed by the laws of the Commonwealth of Pennsylvania and applicable US federal law, without regard to conflict-of-law principles. You agree to the exclusive jurisdiction of the state and federal courts located in Pennsylvania for any dispute arising out of or relating to these Terms or the Services. Nothing in this section deprives you of the protection of mandatory consumer-protection laws of your country of residence where they apply.

13. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Services after an update constitutes acceptance of the revised Terms.

15. Entire agreement and severability

These Terms, together with the Privacy Policy and any additional terms for a specific event or campaign, constitute the entire agreement between you and us regarding the Services. If any provision is found unenforceable, the remaining provisions will remain in full force, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable. Our failure to enforce any right or provision is not a waiver of that right or provision.
